Under Swiss Law
Art. 1 Scope of Application
These Terms & Conditions apply to all contracts for the delivery of digital content concluded between Winify AG, Switzerland (hereinafter "Provider") and the customer (hereinafter "Customer").
Deviating conditions of the Customer are not recognized unless the Provider expressly agrees to their validity in writing.
These Terms & Conditions are subject to Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Art. 2 Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding offer according to Art. 3 Swiss Code of Obligations.
Order Process:
- Selection of the desired product
 - Registration or login
 - Entry of payment details
 - Review and confirmation of the order
 - Receipt of order confirmation by email
 
The contract is concluded upon receipt of the order confirmation by email (Art. 1 para. 1 Swiss Code of Obligations).
Art. 3 Prices and Payment
All prices are in Swiss Francs (CHF) or Euros (EUR), depending on the customer's location. Value added tax is shown in accordance with applicable regulations.
VAT Regulations:
- Switzerland: 2.5% VAT (reduced rate for e-books)
 - Germany: 7% VAT (reduced rate)
 - Austria: 10% VAT (reduced rate)
 - Other EU countries: According to local VAT rates
 
For turnover under CHF 100,000 per year, no VAT is shown (small business regulation according to Art. 10 para. 2 Swiss VAT Act).
Available Payment Methods:
- Credit Card (Visa, Mastercard, American Express)
 - SEPA Direct Debit
 - PayPal
 
Payment is processed via the payment service providers Stripe and PayPal. The purchase price is due upon conclusion of the contract.
Art. 4 Delivery of Digital Content
After successful payment, you will receive immediate access to the purchased digital content via your user account.

 - Access to 40 interactive financial tools
 - Lifetime access to your user account
 - Free updates
 
All downloads contain a digital watermark with your customer ID to prevent unauthorized distribution.
Art. 5 Right of Return
No Statutory Right of Return in Switzerland
Swiss law does not provide for a statutory right of withdrawal or right of return for online commerce. This was discussed and rejected in the Council of States and National Council.
Any voluntary right of return expires upon download of the digital content. The contract is fully fulfilled upon provision of the downloads.
Warranty for Defects:
In case of technical defects or if the service was not provided as agreed, you are entitled to statutory warranty rights according to Art. 197 ff. Swiss Code of Obligations. In this case, please contact us at: info@programmed-money.com
For EU Customers:
Customers from EU countries have a 14-day right of withdrawal according to EU Directive 2011/83/EU. However, this expires upon download of the digital content, provided you have expressly consented to immediate provision and confirmed that you thereby lose your right of withdrawal.
Art. 6 Usage Rights and Copyright
With the purchase, you acquire a simple, non-transferable right of use for private use according to Art. 10 Swiss Copyright Act.
Not Permitted:
- Transfer to third parties (Art. 12 Swiss Copyright Act)
 - Public distribution (Art. 10 para. 2 Swiss Copyright Act)
 - Commercial use
 - Reproduction beyond private use
 - Removal or manipulation of the watermark
 
Violations of copyright can be prosecuted under criminal and civil law (Art. 67 ff. Swiss Copyright Act).
Art. 7 Liability
The Provider is liable according to the provisions of the Swiss Code of Obligations.
Scope of Liability:
- Intent and gross negligence: Unlimited liability (Art. 100 para. 1 Swiss Code of Obligations)
 - Slight negligence: Liability only for breach of essential contractual obligations, limited to typically foreseeable damage
 - Auxiliary persons: Liability for auxiliary persons according to Art. 101 Swiss Code of Obligations
 
Liability for indirect damages and consequential damages is excluded to the extent legally permissible.

Art. 8 Data Protection

Art. 9 Applicable Law and Jurisdiction
All legal relationships between the Provider and the Customer are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
The exclusive place of jurisdiction for all disputes is the registered office of the Provider in Switzerland, unless mandatory legal provisions provide otherwise.
For consumers from EU countries, the mandatory consumer protection provisions of their country of residence apply.

The Customer acknowledges that they have read, understood, and accepted this disclaimer and assumes all risks associated with the use of the provided information.
Art. 11 Severability Clause
Should individual provisions of these Terms & Conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid one that comes closest to the economic purpose of the invalid provision.
